A couple of interesting posts on Ralph Cipriano's bigtrial blog today.

The first one is titled "Sandusky's Lawyers Charge A.G.'s Office With Brady Violations" and it discusses yesterday's filing from the Sandusky legal team concerning OAG Brady violations and the request for Judge Foradora to re-open the PCRA case record to include the email between Mike McQueary and Jonelle Eshbach that Ray Blehar discovered.

I wonder if Judge Foradora will honor the request. We should find out shortly as he stated on Monday that his ruling in the PCRA petition will be posted on the Centre County web pages by 12 noon sharp today. It should be an interesting day.

The other post is titled "Spanier's Lawyers Say Statute Had Run On Crime He Was Convicted Of." This entry discusses yesterday's filing in Commonwealth Court by Spanier's legal team and why Spanier will win his appeal.

IMO, Bigtrial is fast becoming the blog of record for the latest developments in the Penn State fiasco.

IMO, Bigtrial is fast becoming the blog of record for the latest developments in the Penn State fiasco.
There are several interesting issues in the Spanier appeal, some substantive and some procedural. Legal scholars will be writing on this whole thing for decades.

Both cases will be strong contenders to be fodder for the writings of legal scholars for the foreseeable future.
 
Serious question. Does this case set a precedent where all Statute of Limitations laws and protections become irrelevant? This case makes them seem meaningless, and a great way to crucify almost any political adversary in the future.

The way the AG's Office had to manipulate and manufacture so much fake evidence, and break so many laws to do it, is why there are so many questions about Sandusky to this day. You can't help questioning the political motives when EVERY trained and licensed medical and child care professional and organization get off scot free, while we spend millions to put untrained jocks and college administrators in jail.

And this helps kids????? Give me a frikin break.

Given that the legal system saw verdicts of Not Guilty on any conspiracy or cover up charges, there must be another answer. Perhaps it was simply not understanding the behavior of a kind of person, a "good guy" predator, who is very good at hiding these things--as Clemente has noted repeatedly is usually the case in these situations. Or perhaps it was the state that screwed up in 1998 when it was reported to two state agencies. Which did nothing.
 
The OAG seems to be covering up for...the OAG and its porn fetish. Maybe the OAG likes kids a little too much.
 
Speaking of legal scholars, Penn State has two law schools - one in Carlisle and one at University Park. Often law school students and profs bend over backwards to challenge rulings, critique procedure, opine on witnesses, champion the accused, etc. How come none of the law school people at PSU have said anything about this case with its obvious sloppy process, unprofessional participation by university general counsel, and witnesses flipping stories? Maybe they're using this case as a blatant counterexample of how you shouldn't run a grand jury investigation and a prosecution.

The folks putting Bigtrial together have made clear that they lie on the side of the truth with their articles in support of the true victims of this "scandal" (especially Messrs. Sandusky, Schultz, and Curley, Dr. Spanier, and the late Coach Paterno), as well as the articles calling to task the true perpetrators (the "accusers" and their attorneys, MM, Ganim, the OAG, and others).

It's refreshing to see Trustee Lubrano post articles from Bigtrial on this board to let us know he's on the side of the truth as well (hopefully along with the rest of the A9). It's a shame more support can't be given publicly, but it's obvious what happened to Trustee Lord when he dared utter "so-called victims".

The fight for the truth was dealt yet another setback yesterday by the ever-corrupt judiciary of the Commonwealth of Pennsylvania, but I know those who have been fighting for the truth will continue fighting and eventually gain justice for those wronged by this affair and, God willing, realize a day when Coach Paterno can be finally recognized and celebrated for what he did and who HE WAS, not just by Penn State but by the whole nation.

Ralph Cipriano has done an excellent job with his bigtrial blog. His coverage of not only the Penn State fiasco but also concerning the injustice asociated with the Billy Doe/Philadelphia Catholic Church case and others has been top notch. I don't believe he will shut down his operation in the foreseeable future.

I agree that the fight will go on. Al Lindsay was poignant is his press conference after the ruling was published. His comments of what happens next and views of how an innocent man could find himself guilty of heinous crimes and facing a virtual life sentence despite evidence to the countrary is a must hear for anyone interested in what exactly happened in this saga. I think there is a good chance that the ruling will be overturned on appeal. The story is not going away anytime soon. I believe it will be a story told in law schools and other venues for a very long period of time.

I'll ask my grandson, Jobie, he's in second law at Penn State. Maybe he can provide us with some feedback.
 
The OAG had adequate reason to arrest/ indict Sandusky. That much I understand. Why if indeed he is such a prolific serial pedophile they had to resort to guerrilla (questionable) tactics and intentionally stretch the truth to include PSU...that's another matter. Tim, Gary and Graham were nothing more than victims of political prosecution and there can be no other interpretation, given that Raykovitz and others were protected by the OAG. The Commonwealth OAG has been used for political reasons for years.

The reason was the OAG plays to win. The case wasn't that strong so they resorted to playing hardball. I believe that Tom Corbett's sight was set on Graham Spanier from the beginning because Spanier had the audacity to question his extreme cuts to higher education and was publicly seen with his Democratic opponent for Governor. They needed to do whatever to prove that Spanier was also guilty after they thought that Sandusky might be a pedophile. They hoped that they could get key players at Penn State to play ball and then everything else would fall into place. They were able to convince Mike McQueary and Cynthia Baldwin to play ball and eliminate any liability that they might have had, but Tim Curley and Gary Schultz didn't want to play ball so they weren't so lucky. Do you have a better explanation for the false grand jury presentment, the grand jury leaks, the suggestive interviewing techniques used by investigators, and the knowingly false statements made at trial (denying discussing testimony in courthouse hallway and stating the v2 was known only to God) and other acts of prosecutorial misconduct? If Sandusky had been a hardened pedophile for over 40 years, it should have been a slam dunk case and the OAG should have been able to prove the case on its own merits and not have needed to resort to such shenaningans. The only problem was the evidence wasn't that strong.

I agree with NCIS Special Agent John Snedden that the fiasco will ultimately be viewed as a political hit job rather than the Penn State sex scandal.
