Would the obligation of the bi-lateral extradition treaty trump the violation of her Constitutional rights? Would Kerry and the State Dept. intervene and make a deal on her behalf? This one is fascinating.

Double Jeopardy Protection?

She doesn't have DJ protection per se, however, the Dept. of State does have the ability to refuse extradition, may well do so if it feels that her basic human rights have been violated, and this inquiry may involve consideration of double jeopardy concepts, particularly since she was not only previously acquitted but adjudged actually innocent.

For an example of this working the other way, look up the case of Pietro Venezia, who Italy refused to extradite even though the death penalty was taken off the table as stipulated in the extradition treaty.

Thanks. Italian Ct. blocks extradition, citing Fla. death penalty - link

This one is really unusual in that the U.S. did agree to allow the Italian Court to try him after Italy had refused extradition, and he was convicted and sentenced in Taranto.
