    On Wednesday morning, Speaker of the House Nancy Pelosi and House Intelligence Committee Chairman Adam Schiff held a press conference to recap the current standing of events in the impeachment inquiry into Donald Trump and discuss where things are going in the near future. Pelosi began by pointing out that the House has advanced bills on issues such as prescription drugs that are still being stalled by Trump and Mitch McConnell. Schiff followed up by listing the actions that the House has taken to date—including hearings that have already taken place, those scheduled in the near future, and the scope of items under consideration. But it was in the question-and-answer session that both Schiff and Pelosi became more forceful about the situation, and in particular about actions taken by both Trump and Secretary of State Mike Pompeo to obstruct an impeachment inquiry.

    In questioning, Schiff hammered both the actions that Pompeo has taken in an attempt to block the testimony of State Department officials, and the moves made by Trump to threaten the identity—and life—of the whistleblower. Schiff was explicit in saying that Trump’s repeated messaging that he wants to know the identity of the whistleblower, his comparison of the whistleblower to a spy, and his talk about how to handle spies are an explicit incitement to violence. Trump’s words aren’t just threatening the Constitution and the oversight role of Congress. They’re threatening lives.

    “The president wants to make this all about the whistleblower and suggest people that come forward with evidence of his wrongdoing are treasonous and should be treated as traitors and spies," said Schiff. "This is a blatant effort to intimidate witnesses.”

    Schiff noted that when the Constitution was written, the concerns over problems that could arise with executive power were exactly in the area where this inquiry falls. “If this conduct doesn’t rise to the level of a concern the founders had,” said Schiff, “what conduct does?”

    Pelosi said that the area of this inquiry was right “in her wheelhouse,” since before she became speaker of the House, she had been the ranking Democrat on the House Intelligence Committee. She agreed with Schiff about both the nature and the seriousness of the crimes under investigation. And she supported the need for congressional action to require that testimony be heard and documents turned over with alacrity. The founders, said Pelosi, “put guardrails in the Constitution” because they knew there was the potential for the misuse of executive power. “They never thought there would be someone who would kick those guardrails over.”

    Schiff made it clear that any additional stonewalling and any attempts to prevent witnesses from testifying would be viewed directly as nothing short of obstruction, and that even though it’s clear that what Trump did was simply wrong, “There is a great deal more we need to know to appreciate the depth of the president’s misconduct.”


    Asked about how she could continue to work with Trump, Speaker Pelosi provided some details of her call with Trump that came just before the release of the nontranscript of the call with Ukraine. Trump started the call by telling the speaker that she would be “very pleased” about actions he was taking on gun legislation. But then he tried changing the subject to the Ukraine call in an attempt to get Pelosi to drop the topic. Instead, Pelosi made it clear to Trump that his call was “not perfect, it was wrong.”

    Overall, the press conference showed that the Democratic House is moving rapidly to gather the information it needs to press this impeachment against Trump and everyone else who engages in obstruction and intimidation. Both Pelosi and Schiff made it clear that they would be moving deliberately but swiftly to collect the information necessary, and that the days of allowing witnesses to dodge subpoenas and evade questioning are over.

    House Speaker Nancy Pelosi reflected somberly Wednesday on the task before her Democratic caucus regarding the impeachment inquiry into Donald Trump’s conduct on a phone call with Ukrainian President Volodymyr Zelensky.

    "This is about the facts relating to the Constitution, and that is how we proceed," Pelosi told reporters, "with dignity, with respect, prayerfully and, again, worthy of the sacrifice of our founders, the sacrifice of the men and women in uniform who fight for our freedom, and the aspirations of our children so they will live under future presidents who will honor the Constitution of the United States."

    Back at the White House, which has adopted no messaging strategy on impeachment, Trump erected his own personal war room on the fly in response to Pelosi's clearly offensive (eh-hum) inferences.

    "The Do Nothing Democrats should be focused on building up our Country, not wasting everyone’s time and energy on BULLSHIT," Trump tweeted, "which is what they have been doing ever since I got overwhelmingly elected in 2016, 223-306. Get a better candidate this time, you’ll need it!"

    Pelosi was joined at the press conference by Rep. Adam Schiff, chair of the House Intelligence Committee, who was asked about his response to Republicans who say that Trump's phone call with President Zelensky may have been improper, but it wasn't impeachable.

    “It's hard to imagine a set of circumstances that would have alarmed the Founding Fathers more than what was in that call," Schiff responded, "it's hard to imagine a more corrupt course of conduct."

    Trump had some thoughtful words for Schiff, too.

    “Adam Schiff should only be so lucky to have the brains, honor and strength of Secretary of State Mike Pompeo. For a lowlife like Schiff, who completely fabricated my words and read them to Congress as though they were said by me, to demean a First in Class at West Point, is SAD!” Trump tweeted.

    Shortly after the Pelosi/Schiff press conference, Trump continued with another dignified round of name-calling from the Oval Office, dismissing Schiff as "Shifty Schiff" and a "lowlife" who should resign and be investigated for "treason." Naturally, all of those musings are insane—just evidence of the fact that Trump is deathly afraid of being impeached and trying to claw the eyes out of the man who's guiding the inquiry into him.

    At the press conference, Schiff promised that any "stonewalling" of the inquiry by the Trump administration could be turned into an article of impeachment. “Any action like that, that forces us to litigate, or have to consider litigation, will be considered further evidence of obstruction of justice," Schiff said.

    But Pelosi also emphasized that Democrats must be "fair" with their inquiry. "This is sad. We have to be prayerful," she said. "We have to be worthy of the Constitution as we go forward. We have to be fair to the president, and that's why this is an inquiry and not an outright impeachment."

    Secretary of State Mike Pompeo is in Rome, engaged in what appears to be a crash program to turn Q-level conspiracy theories about the 2016 election into something that Donald Trump can throw into the path of the whistleblower train that is bearing down on him and everyone in his White House. For the past week, even as details of the call between Trump and Ukrainian President Volodymyr Zelensky revealed that Trump had done everything, and more, that the whistleblower had claimed, Pompeo has claimed not to know the details. He’s repeatedly feigned ignorance about both the complaint and its contents. But in front of the international press on Wednesday, Pompeo was forced to admit what had already become public knowledge the day before: that he was present for the phone call.

    Pompeo was listening in as Donald Trump made it clear to Zelensky that unless he joined in in an effort to frame Joe Biden, with a side order of bolstering a Hillary Clinton conspiracy theory, Trump was going to continue withholding vital military aid from Ukraine.

    Pompeo didn’t just know. Pompeo was part of it. After finally admitting that he was there for the call, Pompeo went on to claim that the call from Trump was consistent with the goals of ending corruption in Ukraine and protecting the country from Russia. Which is odd, because the only way to read the not-a-transcript provided by the White House is that Trump was conducting a massive shakedown of Ukraine while threatening it with Russia.

    Still, no matter how ridiculous Mike Pompeo’s claims about the call may be, there’s one thing now certain—Pompeo himself is a fact witness in the impeachment inquiry, who can be called to testify directly about key events in the still unfolding Ukrainian scandal. That also means that anything Pompeo does to prevent State Department officials from testifying is a direct and overt instance of obstruction, protecting not just Trump but himself too from potential impeachment and criminal charges.

    An "urgent" congressional briefing taking place Wednesday between the State Department inspector general and lawmakers reportedly centers on alleged instances of political retaliation against career agency officials who wish to cooperate with Democrats’ impeachment inquiry. No details of that retaliation were immediately available, but the IG, Obama holdover Steve Linick, requested late Tuesday to meet with members of eight separate congressional committees to share certain documents related to the investigation into the State Department and Ukraine.

    The briefing comes on the heels of sparring on Tuesday between several House committees and Secretary of State Mike Pompeo, who accused Democrats of trying to bully State Department officials into cooperating with their impeachment inquiry. Democrats issued their own response, ordering that Pompeo "immediately cease" his witness intimidation.

    Of course, Pompeo is now a fact witness in the inquiry after he admitted Wednesday morning that he had indeed been on the phone call between Donald Trump and Ukrainian President Volodymyr Zelensky, an admission Pompeo had dodged for weeks in multiple interviews.

    Now it appears that political appointees at the agency, under Pompeo's direction, have been intimidating career diplomats who are trying to cooperate with the investigative requests made by House Democrats. Just one more instance of a cover-up related to Trump's supposedly "perfect" call.

    Now there’s a great precedent. If you blow whistles at people the president approves of, you’ll be fine. If you cross the president, and the president thinks you’re illegitimate (which he will because, I mean, come on), well … what size cement shoes do you take? 11? We want you to be as comfortable as possible while we murder you.

    The Justice Department told White House personnel on Wednesday that they must preserve all notes regarding President Donald Trump's meetings and phone calls with foreign leaders.

    "Defendants today instructed relevant personnel to preserve the information," Justice Department lawyers told a federal judge in a court filing.

    The question of whether the White House was preserving the information arose in federal court Tuesday, following government transparency and historical archivist groups' emergency request to maintain the notes from the Trump-Volodymyr Zelensky July 25 call and other Trump discussions with world leaders.....

    The Democratic head of the House Intelligence Committee, Representative Adam B. Schiff of California, learned about the outlines of a C.I.A. officer’s concerns that President Trump had abused his power days before the officer filed a whistle-blower complaint, according to a spokesman and current and former American officials.

    The early account by the future whistle-blower shows how determined he was to make known his allegations that Mr. Trump asked Ukraine’s government to interfere on his behalf in the 2020 election. It also explains how Mr. Schiff knew to press for the complaint when the Trump administration initially blocked lawmakers from seeing it.

    The C.I.A. officer approached a House Intelligence Committee aide with his concerns about Mr. Trump only after he had had a colleague first convey them to the C.I.A.’s top lawyer. Concerned about how that initial avenue for airing his allegations through the C.I.A. was unfolding, the officer then approached the House aide. In both cases, the original accusation was vague.

    The House staff member, following the committee’s procedures, suggested the officer find a lawyer to advise him and meet with an inspector general, with whom he could file a whistle-blower complaint. The aide shared some of what the officer conveyed to Mr. Schiff. The aide did not share the whistle-blower’s identity with Mr. Schiff, an official said.

    “Like other whistle-blowers have done before and since under Republican and Democratic-controlled committees, the whistle-blower contacted the committee for guidance on how to report possible wrongdoing within the jurisdiction of the intelligence community,” said Patrick Boland, a spokesman for Mr. Schiff.....

    Hosting Robert Jeffress on his radio show on Monday, Fox News host Todd Starnes seemed to agree with Jeffress that Democrats don’t worship the Christian God, but may worship the pagan god Moloch, a god associated with child sacrifice. Now Starnes is out at Fox. Whether the two things are related or not is unknown.

    This is somewhat satisfying to us at the Military Religious Freedom Foundation (MRFF), who for years have had to put up with Starnes maligning and lying about our organization and its founder Mikey Weinstein every chance he got.

    Among other names, Starnes once called Weinstein a “a special kind of low-life,” and has incessantly referred to MRFF as an atheist organization bent on removing all religion from America, despite being told repeatedly by MRFF’s attorneys that MRFF is not an atheist organization. (Not that there’s anything wrong with atheist organizations; we just don’t happen to be one.)

    So, Starnes, who was once fired from the Baptist Press over factual errors, will now have to take his factual errors somewhere other than Fox News.

    The Washington Post is reporting that Donald Trump repeatedly used Vice President Mike Pence to pressure Ukraine’s leadership, but Pence's aides maintain that Pence was an unwitting accomplice to Trump's desire to spur an investigation into political rival Joe Biden.

    Unwitting or not, Pence played a consistent role in Trump's pressure campaign. Pence was reportedly instructed by Trump to skip the inauguration of incoming President Volodymyr Zelensky in May after White House officials had added it Pence's schedule. Following the now-infamous July 25 call, Pence also informed Zelensky at Trump's behest that military aid was being withheld from Ukraine until the country got tougher on corruption. Reportedly, the Ukrainians simply "understood" what that meant: They had better investigate the Bidens, or else.

    But Pence would have to have been functioning in a fog of ignorance not to know that something improper was happening. For instance, May was also the month when the U.S. ambassador to Ukraine was recalled by Trump, and that reports revealed Rudy Giuliani planned to travel to Ukraine to push an inquiry into the Bidens. And then there's this nugget:

    Perhaps most significantly, one of Pence’s top advisers was on the July 25 call and the vice president should have had access to the transcript within hours, officials said. [...] Officials close to Pence contend that he traveled to Warsaw for a meeting with Zelensky on Sept. 1 probably without having read — or at least fully registered — the transcript of Trump’s July 25 call with the leader of Ukraine.

    Um, Pence wasn't apprised of the July 25 conversation by his aide who was also his national security adviser? Then Pence didn't read the transcript related to the leader of a country with whom he was conducting diplomacy? And finally, before he traveled to Poland to meet with Zelensky in early September, Pence never read about the call as part of his briefing materials?...

    It’s the obvious next front in staying in Donald Trump’s hotels to suck up to him: booking rooms in Donald Trump’s hotels and not even using them. House investigators say it appears that has happened at least twice, once involving a foreign government and once involving a trade group, and they’re looking into how many other times it may have happened—along with the stuff we already knew about, like Trump trying to get a G7 summit at his Florida Doral property and Mike Pence staying at his Irish hotel.

    There is, though, a difference between saying “I have to stay somewhere, so I’ll butter Trump up by staying in his hotel” and saying “why not just book a bunch of rooms I don’t need to funnel money directly to Trump?” And it punches quite the hole in Trump’s “people stay in my hotels because they’re the best” line of defense if people (and by people I mean governments and business groups) are paying to not stay in his hotels.

    “Now we’re looking at near raw bribery,” said Democratic Rep. Gerry Connolly of Virginia, one of the members involved in investigating the issue. “That was the risk from day one—foreign governments and others trying to seek favor because we know Trump pays attention to this. ... It’s an obvious attempt to curry favor with him.”

    This is part of the House Oversight Committee’s continuing investigation of Trump’s violations of the Emoluments Clause of the Constitution, and while it’s not formally a part of the impeachment inquiry at this point, Politico reports that Speaker Nancy Pelosi might allow some issues beyond Ukraine to become part of it.

    Complaint drafted 'entirely on their own,' Whistleblower attorney says

    Attorneys for the whistleblower at the center of a growing impeachment inquiry related to President Donald Trump and a phone call he had with the president of Ukraine are pushing back on any suggestion their client worked with a member of Congress to write the complaint that sparked a new push by congressional Democrats.

    "The Whistleblower drafted the Complaint entirely on their own. Legal counsel Andrew Bakaj provided guidance on process but was not involved in the drafting of the document and did not review it in advance," Mark Zaid, an attorney for the whistleblower, told ABC News. "In fact, none of the legal team saw the Complaint until it was publicly released by Congress. To be unequivocally clear, no Member or congressional staff had any input into or reviewed the Complaint before it was submitted to the Intelligence Community Inspector General."....
