I listen to ESPNU often on XM radio.

There is one commercial that plays often in Football season. I think its a station promo, but the start out by saying "From Happy Valley to Death Valley...". They later add "From White out to Black Out". Finally, there is a "We are... <small pause> then something other then "Penn State" to close out the spot.

Penn State wasn’t the first to say it... same for white out. I think you have to create something unique and then trademark it. If someone else can prove they used it before you then you can’t trademark it. I think...
