For Punter to maintain protection, it must be obvious he is going to punt. When he pulls the ball up and starts running sideways, it is unclear what he is going to do. If he turns to punt as pursuit closes in which is what causes the contact (i.e., he waited too long to make it clear his intention was to punt), it is not a penalty.
